I want to wait on a response from the campaign to form an opinion on
this, but I have to think that even if they were planning any kind of criminal hearings and/or prosecutions, they can't talk about it during this election, especially with a message of hope and looking forward. It would be self-manufactured ammo for the GOP. Incessantly repeating all the way up until November, and likely beyond, that Senator Obama wants to tie up time and money, that we don't have, prosecuting past mistakes rather than solving them. All the while periodically triggering the semi-dormant primal fear that still enslaves some of our citizens by constantly reminding them everything done in the way of conspiracy, torture, and murder was/is for their own safety. Something like..."We haven't been attacked since 9-11, yet, but hey, the "democrat party" has been in charge for almost two whole years now, so...who knows?" The fact that the democrats have let them do just about whatever they want won't matter to those looking for a reason to blame their problems on the impotent Democrats.
Of course, the democrats can investigate the war criminals and deal with current economic crisis at the same time, but at least half of the American public doesn't have faith that any government body or official could handle such an undertaking. This view will be even more extreme particularly later in the year, when many will be figuring out what a struggle it's going to be just to pay their heating bill this winter.
